碩士 === 中央警察大學 === 水上警察研究所 === 101 === Observing the cases of the ship collision over the years, we found them having a high degree of foreign and complexity, often accompanied by human casualties, pollution of the marine environment, as well as damage to the cargo which led to criminal, administrative, civil responsibility. Such as the collision of two parties of different nationalities, but also involves the issue of national jurisdictions, collision waters, such as at the International Law of the Sea regulating different waters and different laws applicable for the State jurisdiction. We need to discuss and understand the the jurisdiction permissions of flag State jurisdiction, coastal State jurisdiction and the vital interests of national jurisdiction. The handling of the the sea ship collision accident, not only pay attention to the search and rescue effectiveness issues, we must be concern with the upgrading of skills of the evidence collection and investigation of the cause of the accident analysis. With the continuous development of modern maritime technology equipment and the strengthening of maritime safety management, accident and casualty investigation has also become an integral and important aspect to the safety of maritime traffic management. Through the analysis of the cause of the accident, some reminders and suggestions made to help prevent the re-occurrence of accidents at sea. Watching other maritime advanced countries also have a dedicated investigative bodies responsible for the implementation of the independent nature of the accident investigation, in order to restore the truth. The study focused on the practical processing the ship collision derivative of legal responsibility, the implementation of the legal basis of national jurisdiction, extending to the international system of maritime accident investigation and execution, and finally for the evidence of the accident investigation, cause analysis and modern forensic methods of marine technology.
