The German Federal Data Protection Act came into force in 1978 and thereafter was modified to implement the EU's Data Protection Directive. In the context of EU-integration, the power of member states continued to be shifted from national governments to the supranational bodies of the EU. This means that member states will never be the only actor in the domestic policy-making process. The responsibility is now at least split between two levels: the EU and the member states. Between these two levels, political actors exchange ideas, opinions, and experiences to improve their governance. The same features apply to the policy area of data protection. However, since September 11, 2001, the transatlantic partners enhanced international cooperation in counter-terrorism, which to a great extent relies on exchange of data. Against this background, this paper tries to answer the following questions: How do counter-terrorism policies affect data protection governance in the EU and in Germany after 9/11, and how do actors in Europe and Germany interact to address data protection issues?
