The impartiality and expertise in identifying and investigating into a fire cause is highly relevant to determination of any civil and criminal liabilities. A lack of impartiality would undermine the fairness in the risk allocation in accountability for fire, and jeopardize the rights of all related parties. Therefore, in order to foster fairness in the risk allocation in accountability for fire and to promote social welfare, it is necessary to consider the independence and impartiality in fire investigation courses in the light of related practice in developed countries. This research is aimed at: (A) Making comparisons among the implementation results of impartial third institutes undertaking fire investigation, which have been established in the United States, the United Kingdom, Japan, China, etc.; (B) Analyzing and reviewing the existing fire investigation system in our country, as well as the necessity and feasibility of establishing impartial third institutes to promote fairness in the risk allocation in accountability for fire liability. It is anticipated to achieve the following results through questionnaires designed by experts in Delphi Method. (A)Key elements for impartiality should include: Impartiality in conducting site inspections, determination of facts, objective opinions. (B)Key elements for expertise should include: training of professionals, establishment of professional working sites. (C)Key elements for expansion should include: establishment of professional investigation institutes, enhancement of professional forensic skills, cooperation of the Criminal Justice System.
