碩士 === 銘傳大學 === 法律學系碩士班 === 100 === The purpose of this thesis is to discuss the regulation regarding the abuse of dominant bargaining position under the Japanese Antimonopoly Act.Besides, review the circumstances of the abuse of dominant bargaining position in Taiwan. There are seven chapters of this thesis, chapter2 to chapter5 provide the introduction of the Japanese Antimonopoly Act.Then from the standard background, comparative analysis of specific abuse type is described as the main. And the interpretation and application of the analysis, introduced to Japanese Antimonopoly Act of relevant case. Finally, chapter6 and chapter7 to view specifications and applicable to the case of the abuse of dominant bargaining position under the Taiwan Fair Trade Act. Specially introduce to buying power of multiproduct retailers and the obligation to provide information of franchise, and the rules regarding the fair competition codes.In addition, Observe the applicable to abuse of dominant bargaining position. This thesis offers some advice regarding the regulation of the Fair Trade Act, and how it can serve as valuable reference to the Fair Trade Commission.
