碩士 === 中央警察大學 === 水上警察研究所 === 100 === The problems of smuggling, illegal immigration, trespassing fishing through mainland vessels did not exit before 1949 because Kinmen and Shiamen were then under the one sovereignty. However, after 1949, R.O.C. government moved into Taiwan and Kinmen became a war zone with never ending fighting and tensions on both sides. Since then, for over 40 years activities on the sea have completely ceased. Sea vessels of both Kinmen and Shiamen could not cross the dangerous zone. On November 7, 1992, the end to martial law was declared in Kinmen area and political activities in the battle zone were closed. The intention of situation on both sides and the advantage from the geographical position led ships from mainland engage in the illegal activities of smuggling, illegal immigration and trespassing of fishing vessels. This research evaluates and analyses reasons for these illegal activities conducted by the mainland ships in Kinmen Sea Area. It also analyses the factors leading to the present situation through political, economical, and legal aspects. Focusing and evaluating on trespassing-fishing happening more frequently in order to ascertain the locations, date/time and the factor of tides through the statistics of cases seized to find the behavioral patterns and paths of mainland fishing boat trespassing into Kinmen sea area in order to make it a reference for seizing act. Besides smuggling and illegal immigration, this thesis also analyzes another mainland fishing boat·s criminal activity for instance, catching fish through electric-shocks and by explosives. Then it tries to suggest suitable measures for its resolution. In the later part of the thesis it identifies the reasons and factors leading to the illegal activity such as mining sea sand, ascertaining the reasons for this activity as to why it happened, problem analysis to resolution suggests viable measures to protect against this activity. At the end, it focuses on the aspects of laws, rules and regulations for its practical enforcement implementation and recommends measures to overcome these problems.
