Summary:碩士 === 國立雲林科技大學 === 科技法律研究所 === 99 === From the EU of WEEE / RoHS / EuP (waste electrical and electronic equipment / the restriction of the use of certain hazardous substances in electrical and electronic equipment / Eco-Design Requirements for Energy-using Products) directives were legislated, products could be sold in EU only which were comply with those directives, the measure is equivalent to a declaration of the era of green products. Environmentally friendly and Energy-saving product, restrict using of hazardous substances and wastes recycled are not only simply be necessary to comply with regulatory requirements, but sometimes are regarded as indicators of enterprise technology and environment-friendly policy in this century. While technology products sold to all global, no matter it is directly or indirectly, Enterprises in Taiwan have to face the legislation of green production. Rapidly renovation of consumption products lead a lot of waste materials, if we don’t restrict use of hazardous substances in the product manufacturing process, waste will not be recycled or decomposed and will cause irreparable harm to the environment. In this study, we will analyze the current problems of Waste Disposal Act and Resource Recovery Act of Taiwan by discussing the legislative spirit and the relationship between the WEEE, RoHS and EuP directives. Form the opinion, we survey the protocol of Waste Recycling /Reusing law and provide our initial suggestions to safeguard the environment of fairness and justice.
