| Summary: | 碩士 === 國立雲林科技大學 === 科技法律研究所 === 99 === Nowadays, intellectual property rights has been seriously concerned by general public and economically developed countries among which the patent right by a high-profile industry. Accordingly, this study sets the most economic valuable of intellectual property rights, the "Patent right" as the backbone to the patent of the "flow way" for the flesh and blood, to research problems derived from patent circulation. The suggestion is to improve the fashion of supplement by the provisions of the legal system in order to achieve patent circulation in the market and promotes personal or proprietary diversified enterprises to fully demonstrate the value of patents. Furthermore, this study analyzes patent rights by way of circulation and extraction value in business model, pointing out legal issues of patent circulation resulted from uncertain legal provisions respectively by chapters, following the valuation of patents, patent technology transfer and licensing, price of shares, secured financing issues. Then it summarizes the existing system flaw, suggestions supported by patented technology provider as well as recipient, the government and legal persons in different positions to outline distinct patent issues for the purpose of meeting the practical needs. In the end it concludes further suggestions on the direction of the relevant legislation, expected flow of patents in Taiwan in favor of industrial development to create business value and enhance the competitiveness of enterprises, so that the patent certificate is more helpful rather than wallpaper.
