Summary: | 碩士 === 國立臺北教育大學 === 社會與區域發展學系碩士班 === 99 === Some studies have pointed out that Taiwan's democracy and civic education ignored the protection of human rights. However, these studies did not further discuss the reasons and why it has not been paid attention to. This study aimed to use a deeper and micro empirical analysis method to provide some specific solutions to the problem. The author used Norman Fairclough's three-dimensional model as the main framework, and referred to the discursive psychology and hermeneutics’ view. With the interviews, systemic-functional grammar, inter-textual and conversations analysis to analyze the current textbook and learning objectives among three aspects: text, discourse practice and social practice. The conclusions are as follows:
1. There were six characteristics about " people's basic rights and obligations " in the textbooks:
(1)The description of people's basic rights and obligations in textbooks were authoritative. (2) It was only emphasized on categorizing and examples in the Constitution. (3) To reinforce on negative images, but rarely mention about the core purpose of rights and obligations. (4)There were no protection spirits of citizen’s obligations shown in the Constitution Articles. (5)It was unclear of the relationship between rights and obligations. (6)Government, country and the Constitution played important roles in our society.
2. In the discourse and practice of " people's basic rights and obligations " contain four ideologies:
(1) Textbooks are the Bible for practice. (2) The contents in
the Constitution were very incomprehensible.(3)There are lacking of concepts and attitudes about human rights protection.(4) Country and government are unrivaled.
3.Based on the six orders of discourse and the four ideologies, they might result in four problems:
(1) Students relied on their teachers’ words and the textbook too much.(2) Students could not understand the purpose and spirit of " people's basic rights and obligations".
(3)Student could not realize other rights and obligations beside the given examples.(4)We could not train student to obtain ability of supervising and reflecting toward the public authority.
Based on these findings, this study tried to provide several recommendations:
1. To change the contents and display in textbooks with development of diverse materials. 2. We should offer more law-related topic seminars for current teachers to strengthen future training. 3. Reviewers of textbooks should carefully examine on the core values of discipline with their professional backgrounds.4.The future researches can analyze the law-related education content by using micro-text analysis. 5. The human rights issues are very extensive, there are more other issues to explore besides law-related education.
