碩士 === 東吳大學 === 法律學系 === 98 === Taiwan deregulated the ban and let peoples to go abroad for sightseeing in 1979, and the peoples of China Mainland come to Taiwan for sightseeing in 2008. Consequentially, the vigorous development of travel business in both Taiwan and China Mainland, travel dispute between the two sides also inevitably rises in number. Therefore, it is necessary to compare and research the travel dispute and relief system of both sides on Taiwan Strait. Maybe, the system of settle travel dispute in China Mainland could be a reference for Taiwan to institute or revise the law. This study sets out by surveying all the document of the two sides related to travel business such as administrative regulations, Civil Code and the others law. By studying their respective system, this study tries to put forward to enhance the quality of travel and insure rights of both parties of travel contract. This study would base on the research conclusions and put forth some items suggestions. In the part of the organization of Taiwan Tourism Bureau, its rank seems would be lift, and a specialized authorities on travel dispute would be added. In the part of the management of tourism business and legal system, strengthen transparent regulations on tour product information, prohibit the unlawful travel agency, establish a full-time institution for tour guide and tour conductor. In the part of improvement strategy for complaint administration of travel dispute, formulate the operation protocols on the specialized authorities for complaint administration of travel dispute, and sponsor professional training for the mediator of travel dispute, and TQAA would to engage some professional men organizing its committee of travel dispute mediation. In the part of both sides cooperation, they should establish a cooperation system to prohibit the competition by cut price and below the cost level. This study hope above of all suggestions would be helpful to eliminate travel dispute.
