The scale and complexity of this issue is constantly expanding and it brings great impacts on every country in the world. Foreign workers have made lots of contributions to the development in both developing countries and developed countries. However, foreign workers are often subject to unequal treatment or discrimination in practice or in law, their basic human rights have been violated; their remunerations have been illegally deprived. There is huge imbalance in benefits which foreign workers created and the rights they should enjoyed. Although the causes and consequences of this problem in every country may be different, the discrimination against foreign workers seems to be a common phenomenon. Today, the globalization of economy accelerates the labour movement, and also contributes to the scale of foreign labour groups. Nevertheless, every countries increase more and more restrictions on immigration. As a result, discrimination which these economic migrants suffered is getting worse. Foreign workers have become one of the major international groups; the protection of their rights has become an important element of international law. The international community has gradually come to realize that the equality of human beings cannot accomplished if the denial and violations of basic human rights of millions of foreign workers exist. This thesis mainly focuses on the international legal documents regarding foreign workers’ economic, social, political and cultural rights. After reviewing the relevant international norms protecting the rights of foreign workers and the practical situation foreign workers may face in migration process and working environment, the thesis try to analyze the pros and cons of these legal instruments and make some recommendations to promote the protection of foreign workers’ rights.
