| Summary: | 碩士 === 國防大學管理學院 === 法律學系 === 98 === Sexual autonomy is a right which is closed linked to human life. It seems to be an abstract concept but it do exists as well. In a modern society which is almost gender equality, sexual autonomy is not merely an issue for female, because it is an essential right for male and female and also be implemented in human life. In this study, sexual autonomy is the center topic for discussion, and further, Compulsory Indecency (§224 Criminal Code) is another substantial subject. A lot of issues about Compulsory Indecency (§224 Criminal Code) are controversial with the traditional theory. For instance, the definition discrimination among Compulsory Indecency, Sexual Harassment , flirty and so forth; and the doubt of proper implement between Compulsory Indecency(§224 Criminal Code) and Sexual Harassment are all controversial.
In recent years, the practice of Compulsory Indecency(§224 Criminal Code) and Sexual Harassment has produced much more controversial issues. Hence, the core research in this study which is to frame Compulsory Indecency(§224 Criminal Code) is beginning with sexual autonomy, and then study the controversial issues with the traditional theory. Finally, this study ends up with the analysis of practical controversial cases and the advice for amendment of law.
