碩士 === 開南大學 === 公共事務管理學系 === 98 === The government has carry out the regulation of "Community Service" system from the year of 98 in September 1st, it is an international trend of the crime policy, we've fixed the title to "keep abreast of leniency and Severity of crime policy". As our main objective of Criminal policy, the abstract of community Service is an action and behavior of leniency. Execution of under six months determinate sentence or detention belong to short term liberal imprisonment. Since the penalty is short, the execution does not easy to bring beneficial results on admonishment and introspection , also, it’s easy to be contaminated by other inmates with bad habit. Besides, due to be labeling as criminal, those prisoners face the problem and difficulty when they back to society, then they usually suffer the criticism of "nullity intimidation and breeding, on the contrary to emulate the vicious conception with inmates who share the same rotten taste ". Base on above, short sentence of liberal imprisonment is not advantageous way of penalty; government should reduce the execution of it and apply other substitute measurement. This study is based on the surveys from the point of view of the short sentence prisoners. Through the analysis of existing data from official literature and current database, found that many prisoners have insufficient understanding of the community service system, some consider that the standard examination from procuratorial organization is over the norm. As the matter of fact, most of the prisoners are willing to transfer his own imprisonment to community service, and think that the structure of the short term imprisonment has improper effect and result; they strongly identify with the estimated benefit of community service policy and do expect government can put the essence of this law into effect. The Criminal regulations of Community Service has been amended many times, Superior Judge conference also provide explanation few times, reveal the complication of this regulation. This research has been put forward some suggestions for the execution of Community Service Policy, and anticipate that this system will gradually become impartial and precise by constantly reform and amendment, to increase the satisfaction and trust of public toward the enhancement of Criminal Code by government.
