Summary: | 碩士 === 華夏技術學院 === 資產與物業管理研究所 === 98 === In the "Action Plan and Research Flagships of Service Industry Development Framework " approved by the Executive Yuan in 2004, the property management industry had been listed as the fifth priority of service industry and was defined as: "an industry that combines the scientific and managerial technology, takes into the consideration of the extension of the building life cycle as well as user’s needs, provides professional management and maintenance for the application, living, and business support as well as asset of building and environment.”
The vague definition of the "security maintenance" in current relevant standard contracts of property management of “The contract template for the commissioned management and maintenance of apartment building management company” deliberated by the Ministry of the Interior Construction and “The security guard contract template” issued by the National Police Agency, has caused the problem of co-competence between industries of management maintenance and security guard. In order to avoid the unnecessary controversy and violate the security industry law, the adoption of the to above two regulations in industries has been not as good as originally expected. This study made a comparative analysis of contracts between current contract templates of apartment building management and maintenance security guard standard contract, and focused on the review and analysis of the definition of “security guard” between apartment building management industry and security guard business, so as to clarify the distinction between works of the “Access Control” for the management and maintenance industry and the “Security Guard” for the security industry. This research proposed:
(A) To clarify the definition of the "security maintenance" as soon as possible; to re-adjust the business range between "Apartment building management and maintenance industry" and "Security industry"; to allow the management and maintenance companies to handle accesses which do not require special professional security management. The security guard companies are also able to execute the apartment building management business as long as they are qualified.
(B) To recommend the government departments to coordinate with each other and relax the operational restrictions of licensing industries so as to supervise and manage the maintenance and security industries from a higher aspect; to facilitate the cooperation and development of property management industry, as well as assist the industry to expand its scope of business to provide consumers more completed service so as to improve the quality of the property management industry standards to attract talented people into this industry; to create an all-win situation among security industry, management maintenance industry and consumers.
