By using the investigation method, four kinds of scales were used: “Attitude about traditional culture”, “Attitude about elder’s physical and mental health”, “Attitude about criminal justice”, and “Attitude about the type of elderly crime and the life in prison.” The number of the research samples who are familiar to the law system was 232. It included teachers and students from the Law department, Soo-Chow University, attorneys in Tai-E patent & law office, and the police in Taichung County Police Bureau. Samples of lay people were 227 from students of the history depqrtment of Taiwan National Normal University, the psychology department of Asia University, the electrical engineering department and Taiwanese literature department of Chung-Cheng University, and soldiers in Taipei Military police station. Descriptive analysis, exploratory factor analysis, MANOVA, and path analysis were used to analyse the data. As the results, we found that first, the lay people samples shown strong support toward the legislation of elderly criminal more than the samples who are familiar to the law system. Second, we found that the adult samples shown strong punitive attitudes toward elderly criminals. Third, we found that people who have had well experiences getting alone with the elder people tended to show more tolerant attitude toward elderly criminals.
