It leads to the fact that banks face serious excess putting and non-performing assets problems, which cause a lot of collateral to be auctioned by the court. and most of them are real estates. Legal auction is the key channel for financial institutions to deal with the overdue loans, but the result is directly impacted by the court efficiency. The auctions always take time due to the bid price is usually higher than expected. In order to minimize the loss,banks sometimes act as priority creditors to take over the real estate collateral auctioned by the court. The study adopt the document analysis method ,a case study and in-depth interview to discuss the attribution both on general real estate including the land, location of the houses and the auctioned house that banks are willing to take over, like house status, court eviction order. Further more to study on the factors which impact the bid pricing decision by banks.
