It is enacted for the protection of the rights of labores, The Act is to provide minimum standards for working conditions, protect workers' rights and interests, improve employee-employer relationships and promote social and economic developments.The public sector plays a role as the maker of the Labor Standards Act and the promtor of the labores policy as well.To promote the implementation of the law is to be duty-bound in order to be a good quintessence for the private sector.
Council of labor affairs,Executive Yuan on 30th November 20007 has enacted the temporary staffs of the public sector will be applied the Labor Standards Act from 1st January 2008.According to the investigation of Taipei City Government , there were totally 74,813 staffs and among them there were 4,347 staffs which occupied 5.81% of the total employment.On the basis of the 2008, the Taipei City Government should pay the temporary staffs that included years of service of their severance and retirement and compensation of occupational hazards which estimated about 1.3 billion 87 million 90 thousand. It would be a impact on Human Resource management and fianace for the government institutions.
The purpose of this research is to realize the case of the temporary staffs that applied the Labor Standards Act on 1st January of 2007. to the temporary staffs of labor rights in Taipei City Government, public service human resources, financial burden and the influence of the morale of the work incentive, and by the way of discovering the temporary staffs who applied for Labor Standards Act occurring some side effects,in order to build up a set of the module management about temporary staffs ,even more to propose specific and feasible recommendations which could be the reference of the government to administrate the temporary staffs. This research found that the temporary staffs of the public sector who applied for Labor Standards Act,on the view of labor right that would be able to meet the minimum standards to protect working conditions on the purpose of the negative, enhancing the relationship between employers and employees, promoting social and economic development on the positive side. On the public service human resources management, employing a flexible approach for the temporary staffs who could assist the government institutions to handle some temporary,projects and seasonal jobs.It really could achieve the flexibility and quickly into the operational requirements of a suitable organ who the best qualified personnel but didn’t pass the government examinations to be civil servants , This policy could be a good way to solve the deficient of the formal employee and to become an effective employment strategy. On human motivation in the public service the temporary staffs after appling Labor Standards Act, it gives a clear position in the organization, and the public sector as regards a legitimate part of human resource, recognition of identity, would be able to inspire the morale of its inherent and to do their best to serve the institution.
