碩士 === 東吳大學 === 法律學系 === 97 === The continuing contracts may mainly be divided into two groups, “the inherent continuing contracts” and “the continuing supply and demand contracts”.“The right to refuse to perform until the counter-prestation has been performed by the other party” can’t be applied in the prepaid continuing supply and demand contract.For that reason, this study focuses on the prepaid continuing supply and demand contract. In considering the concept of the continuing contract and reasons why the parties sign a continuing contract, it is recommended that the performance guarantee of “obligation satisfied by the business operators of the same business” is the most beneficial to both the parties.
