Abstract
People count on religion spiritually and because of the different religious needs required by different people, so religious places become the core of the religious system. Religious associations, especially Buddhist temples, are placed on the mountainside and the forest land. After my long- term observation and participation, I discover that since the owners of the Taiwanese temples only focus on practicing moral teachings, but are not familiar with laws as well as regulations. They think the temples are not only the center of the religion, but also are good to the faith of regular people. They build up the temples without any permission. Therefore, a lot of illegal phenomenon occur. As a result, I am inspired to research into the existent illegal temples and take them as my research subject. Besides, I take legal procedure of zoning change for Hai-Yu Buddhism Temple as the goal of this research. Based on the goal of research, these methods are confirmed to prove the records and documents. I then investigated the present situation of Hai-Yu Buddhism Temple and will discuss relevant issues according to the questions found in my investigations. Eventually, I bring up the solutions to the zoning change for Hai-Yu Buddhism, and then offer the steps to legally change the zoning for it.
This research consists of five chapters and seventeen sections as follows:
Chapter1 indicates the motive and the aim of this research. Second, tells to achieve the research goal, the research scope, content and restriction are confirmed and then the methods. Steps and procedures are presented for the smooth research progress.
Chapter2 shows by referring to the literature review. The way the system of zoning change is set up. This research presents the reasons why the temples are against laws and regulations and clarifies the topics of illegal temples, and analyzes the event, and the procedures of temple zoning change in order to establish the system of the zoning change.
Chapter3 tells for the smooth procedure of the practical investigation of zoning change for Hai-Yu Buddhism Temple, firstly, according to its development , we know the mountainside which Hai-Yu Buddhism Temple belongs to and then make a “Hai-Yu Buddhism Temple” investigation plan for the practical investigation and to analyze the suitable regulations and procedure of zoning change. In the end, I write the initial project proposal of “Hai-Yu Buddhism Temple”. By the method of sensitivity ,suitability ,carrying capacity ,and compatibility I find that the zoning of site can be changed. For the successful of used land change, we expound further on the questions of the land, the construction on the land as well as the governmental ordinances .
Chapter4 is that the research brings up and analyzes the issues about problems of land, construction of temples and the regulations according to the real situation of the actual environment and site and then offer the solutions and procedure patterns of zoning change of “Hai-Yu Buddhism Temple”.
Chapter5 are the research conclusions and suggestions. This research offers the conclusions of the subjects, the strategies, the procedure patterns and the steps of zoning change of “Hai-Yu Buddhism Temple” as a reference for other temples’ lands and legalizing construction procedures.
