Description
Summary:碩士 === 中國文化大學 === 法律學研究所 === 97 === The thesis aims to discuss the background and operation of the BOT system in Mainland China, expounding on the dis/advantages of the system with a special focus on the concession in the investment contract. Other legal issues such as the rights and obligations of the related entities, warranty from the government, and the resolution of conflicts are also further discussed. Through research and analysis on the Mainland BOT system, the author tried to compare it with the current practice in Taiwan. Examining the legal problems that stem from the Mainland BOT system and their previous solutions, the author also attempted to propose suggestions for improving the BOT system in the legal aspect. This thesis, by reviewing the design and reform of the Mainland China's BOT system, is expected to offer insight for Taiwanese businesses which will invest in Mainland BOT projects and even for Taiwan as whole for its development on the BOT system.
