This study is to survey the precedent cases of judicial decisions which are base on the workers’ compensation in order to reveal the limitation of compensation policy in Taiwan. There are no arguments on the results of accidents’ injury and the official-listed occupational diseases, however, those unlisted occupational illnesses whether must be “in-the-course-of employment and arising-out-of employment” or not have generated attention and controversy. Work overload or occupational stress affect workers’ both physical and mental health, and could result in sudden death (eg. Karoshi), mental disorders even suicide. In today’s competitive work environment, it is pivotal to embody mental disorders in Taiwan’s compensation system. The purpose of this thesis is (1) To understand the Japanese criteria for Karoshi (death from overwork) used by official authority and (2) To study the development process in Japan on “the judgment criteria of mental disorders result from mental burden at work and out of work” and those real cases in court. (3) To give the suggestions to Taiwan’s authority for revising the compensation policy, including to enact the impartial criteria of Karoshi and work-related mental disorders, to accord with ethic principle of justice.
