| Summary: | 碩士 === 中國文化大學 === 中國大陸研究所 === 97 === The focus of this thesis is placed in the following areas: 1, to review of the protection of the right of patent in global perspective; 2, to examine the PRC’s protection of the patent regulations and laws of the Chinese mainland; 3, to analyze the PRC’s strategies of the patent protection under the mechanism of the WTO regulations; and 4, to discuss and comment the governmental governances of the patent regulation‘s implementation under the PRC’s central and local governments. In conclusion, this author finds that although the PRC government in the past years has made whatever possible means to link with the development of patent legislations and treaty-making, it is fair to say that there has severe gap to meet the standard of the world trend to protect the patent rights, both in law and in practice mode. Generally, the PRC’s law making and implementing mechanism have been far behind the standard of the Western nations.
