The dispute is a general urban design challenge since it included the preservation of cultural asset and the construction of a MRT line. Although the event only occurred recently, the decision process is similar to the DuPont (1985) and Bayer (1996) events in nature. All events were developed into political controversies, and caused significant cost to the society. Relevant professional judgment was incompetent and due participation process was ignored. According to the literatures investigated, it was found that the main issue on preservation was imbedded in the scoping of first stage “Environmental Impact Assessment”. On the other hand, the Cultural Heritage Preservation Law was unable to step in on time. This also resulted in missing the opportunity in mitigating the impact in the later period. It is expected that this study will contribute to the mitigation and resolution of the dispute between major public work projects and their impact. By foreign relevant case demonstration, it suggest mostly while inadequate decision procedure resulted in the missing of opportunity to review and revise earlier mistakes through proper participation by various community groups .And hopefully, with improvements on the “value judgment” and “execution process” issues, similar events as DuPont and Bayer in Taiwan in the future will not result in same consequences.
