As a result, countries all over the world have taken tough measures to curb this problem and consider it to be a key item of criminal policy. According to the statistics of Ministry of Justice, about 60% of criminals in Taiwan committed crimes under the influence of drugs. According to an analysis of a criminal investigation review by the National Police Agency of the Ministry of the Interior, this demonstrates that the drug-related crime rate is rising steadily in Taiwan. The domestic drug addiction problem has been consistently high, therefore this phenomenon has had a significant impact on the crime rate. Taiwanese government officially launched its campaign against drug abuse in May 1993. The campaign has lasted over fourteen years, but problems regarding drug abuse have not yet been effectively resolved. Due to the ineffectiveness of the criminalization of addictive drugs, the article focuses on the evidence from research on decriminalization. This research focuses on the movement to criminalize drug abuse via the document’s method of analysis. As a result, a counter-movement aimed at decriminalization has appeared. Two theories have formed surrounding the legality of drug abuse. According to the result of qualitative studies which involve experts with experience in the field and various categories of drug-addicted criminals, we are trying to achieve the goal of forming feasible decriminalization policy and alternative measures. From the inefficiency of drug rehabilitation and of policy implementation, we can see the negative impact of criminalization. We can therefore conclude that decriminalization is essential. However, decriminalization of drugs abuse may cause the drug-addicted criminals commit more crimes without fear. Furthermore, the rate of drug-related crime probably will be soaring. Therefore, to measure who (Drug-addicted criminals) qualifies decriminalization criteria becomes an more important issue. According to the empirical study, the result reveals that it is better to perform gradually in three separate stages for decriminalization. Moreover, in order to improve the effect of decriminalization policy of drugs abuse, researchers strongly recommend to have different measures and policies in the tress stages.
