It is natural for the spouses, parents, children to live together. However, with the globalization and the trend of human migration, the situation might have changed. The cross-national marriages have become more and more popular nowadays. In the past, the spouses may be local people, and be temporarily separated due to work or study, the family reunification would be a problem. But when it comes to one of them is a foreigner, the issues involved would be more complicated. This is not only between two people or two family, but between two countries. According to the current Immigration Act, the foreign spouses may be deported form Taiwan for violating the some current laws or regulations. In fact, the deportation of foreign spouses will separate the members of family and may cause an infringement of their right to family reunification. On the basis of the international human rights, the study is going to explore the impact of the deportation for the foreign spouses in Taiwan, to introduce the EU 2003 Family Reunification Directive, as well as comparing the foreign legal mechanism and cases in other countries. Hopefully, the results of this study will improve the current legal problems for the foreign spouses in Taiwan and to shed the light for our government’s current immigration legislation and policy implementation.
