Summary: | 碩士 === 東吳大學 === 法律學系 === 96 === On-line game industry is regarded as the minor developing target due to its particularity and the characteristic of limited economical scale, and consequently takes on highly un-controlled and operates in its own way . However, after the rapidly developing of business volume and players, there have been dramatic changes on the environment and business model in the decade, although the legal system is not complete enough to regulate innovative applications nowadays facing the continually developing games and game’s mode. In order to face the difficulties, whether it is necessary to improve the current legal system or develop a new management system based on the characteristics of On-line game industry becomes an important issue for the industry.
This study will first introduce the development on On-line Game industry, observe the regulation and incentives of the on-line game industry carried out by Taiwan government as well as the foreign experience, and discuss different newly raised legal issues under the tendency of master stream of digital content industry. In addition, this study will identify different role perspectives in the on-line game virtual society, through the comparative study on role interaction between on-line game business operator and players to distinguish the reasons of legislation and the difficulties as well as evaluate the current legal system in Taiwan.
Based on the principles on self-discipline of on-line game industry, the study brings up the conclusion and suggestions on the standard on-line game contract proposed by Ministry of Economic Affairs. Finally, the study hopes to provide a feasible guideline for the legislation on ubiquitous on-line game industry issue in Taiwan.
