The enterprise intellectual property not only can be used as the defense weapon but also the sharp weapon to attack competitors. In recent years, quantity of patent application in Taiwan is increasing year by year. The Taiwan patents applie to US has been even ranked the 4th in the world. These increases demonstrate that the Taiwan enterprises gradually value the protection of intellectual property rights (IPR). However, the small and medium enterprises (SME) in Taiwan are still frequently sued for infringement, and paying high royalty to obtain the technical authorization. Therefore, how to establish effective IPR management system will be an important issue in business management. This study is to discuss how the IPR is presented, possessed, and applied in the SME, and understand the whole picture in use. By inducting IPR management system into four aspects: the R&D management, the performance management, infringement and authorization management and patent database management, we can verify by real diagnosis research that the patent infringement and authorization will urge enterprises to establish the IPR management system. This research will suggest the implementation order, in terms of the importance of impact, the cost and time in the IPR management system. What the enterprises may firstly establish could be the sole responsibility organization, the staff IPR education and training, the non-disclosure agreement, the non-competition clauses, authorization contract, the control of documentation, and graduation of confidential documents. This research also organizes the implementation order in terms of short, mid and long-term system; and finally recommends how to establish and implement IRP management system for SME in Taiwan.
