Abstract
The articles mainly discuss the intellectual property management of university sector, through the related reference papers gathering and discussion, adopting theories as well as practices to discuss the current situation of the intellectual property management in the university sector.
The mission of university owns the functions of teaching study service, the outcomes come from the research and development ability in the university sector, which also enable to license or transfer to the business sector, therefore, it becomes more and more important of university sector facing the managements among the related patents、trademarks、copyrights sectors. The industry-university cooperation may promote the industry development, it makes university participates in the practice operation from the industry sector, furthermore, the outcomes being utilized and owned by the industry sector, we may call it a mutual benefit、win-win strategy.
In the procession and success of the research and development, the intellectual property management getting more and more important, the continuous procedure in the industry-university cooperation、technology licensing and transfer、commercialization,which requires the related formalization, then, it enhances the intellectual property management intensive and reasonable operating procedure going step by step. Contract is a critical factor to influence the whole procedure, the establishment of law and regulation is the key method to solve the dispute and conflict, therefore, a package of effective system is a must and necessity for an establishment of university intellect property management.
The articles propose the legal system analysis on the university intellectual
property management, according to the studying result, the conclusion and suggestion being proposed for the relevant authorities reference, expecting through the construction of law mechanism, the brand new concept could be shaped on the university intellectual property management.
