To the contrast, there is limited legal documentation related to this practice in Taiwan mainly due to lack of real cases in Taiwanese industries. This study focuses on the critical circumstances in the U.S. antidumping cases. It analyzes the effects on industries and trades between the U.S. and named countries or non-named countries. This study uses the U.S. 8-code USHTS system for trade database, focusing on 245 antidumping cases from years 2000 to 2006. Among those antidumping cases, 60 of them are involved in critical circumstances. The results show that the measures of critical circumstances do cause the trade destruction effect on named countries and cause the trade diversion effect on other non-named countries.
