Summary: | 碩士 === 國立中正大學 === 勞工所 === 96 === The thesis first focus on the three supervisory and administrative mechanisms of the pension fund of our country. And then consult with the primary system of the pension fund of United States, Chile, Singapore, and Hong Kong. Furthermore, the article start to analyze the Labor Pension Fund Supervisory Committees of Law of our country and its connected regulations. Finally, the thesis will propose the conclusions and the advices of the supervisory and administrative mechanisms of the pension fund .
The main conclusions and the advices are as followings:(1) All of the Labor Pension Fund Supervisory Committees of our country are too representative, and they are having low percentage of the experts and scholars, finally causing the deficient in the independency and expertise. Furthermore, the employees of the supervisory committees are restricted to only public officers. This also cause the deficient in the expertise. (2) The three pension fund are all refer to Defined Benefit Plan, and they are also included in the governmental administrative system. This will cause the operations of the pension funds having poor achievements. In case of causing the heavy burden to the financial sector of the government, it is advised to separate the supervisory and administrative functions of the mechanisms of the pension fund and to move to annuity gradually. (3) the Public Service Pension Funds and the pension fund all have the regulation regard to the guaranteed rate of return . Obviously, this will cause the moral hazard, which possibly making the rate of the return of operations hardly to have a excellent achievements. In order to make the operations of the enormous pension fund to have better rate of return, to take more part in the international markets freely, and to broaden the influence of Taiwan’s financial sector, it is advised to make a change of the system of guaranteed rate of return. (4) The system of the three pension funds are all included in public sectors. With the trend to free the government controlled industry into free market, the mechanism of the pension fund, which is extremely important to the elders, is advised to mimic the system of that of United States 401(K), Hong Kong, or Chile. The employees should have the chance to choose their desired trust company. This means that the government plays only the role of making the regulations and responsible for the enforcement of the law. The operations of the funds should free to the market gradually, and this will promote to better achievements of the operations.
