From the point of view in local self-governing, the critical point of putting local self-governing into practice is using of local legislative power. Because of ruled by military-authoritarian system and inherited from the management system of the war time, it is too bureaucratic for Lienchiang County to run the self-governing smoothly. Under the circumstance caused by above, Lienchiang County lacks impetus and ability to push government affairs forward efficiently, which can not meet people’s expectation. In view of establishing autonomous ordinances is important to the administrational efficiency, the local government and the council should achieve consensuses and create a new law system to comply with the direction of Lienchiang County in constructing the future of Matzo.
This paper focuses on local legislative power of Lienchiang County. However, due to the management during the war period was executed in the Matzo district, which ruled by “The Experimental Order of War Affairs in Matzo District” in order to build up a special local administrative system, and also ruled by “Fuchsine Province, Kinsmen County and Lienchiang County local self-governing outline” and “Kinsmen and Matzo pacification ordinance” after the war affairs were stopped, before the local institutional law was executed, the field of this research which starts from the war affairs to the self-governing ordinance in Lienchiang County is meaningful in this way. Besides, to examine the situation of Lienchiang County after executing the local institutional law, treated as a case study can be told whether the “principle of localization” workable. Furthermore, the paper also discusses the application of central law to Lienchiang County, through literature reviews and interviews to find out the status quo and difficulties of the local legislative power in making autonomous ordinance.
Depending on the empirical research above, the paper concludes that the local self-governing ordinance is the key point of construction, finance, public human resources and executing “the mini three links”. In analyzing in organizational power, financial power, personnel power, and legislative power, and also assisted by Constitution, local institutional law, and executive procedural law as the theoretical foundation, the paper raises some suggestions by “localization principle” in solving the local autonomy in Lienchiang County.
