Referring to the World Bank, there are 574 public constructions are invested by private enterprises in 82 countries from 1984 to 1995 and the total amount of investment is over 30.8 billion US dollars. In Taiwan, this is also an irresistible tendency for government. After the implement of the “Law for Promotion of Private Participation in Infrastructure Projects,” remarkable achievements have been continually shown by public sectors. In addition to many success cases, the crematorium in the Yunlin County built under Build-Operate-Own (BOO) is in difficult position. In order to analyze this issue further, this study examine this case with “3i model”, “level-of- analysis” and relevant theories as well as practical experiences and interviews of stakeholders . There are several results concluded in this study: 1. In the case of crematorium, crematorium should be state-own and private-operate. 2. In accordance with the tendency of waste-reducing in Taiwan, the policy of “one county, one crematorium” should be revised. 3. Four appropriate procedures for the improvement of crematoriums which have been/will be operated or still under construction are also delivered as follows: (1) Crematorium with controversy should be arbitrated under the Fair Trade Law. The Government has the right to purchase it with reasonable price, and consequently to transfer it as state-owned one but private-operate. Moreover, the Government should negotiate with financial associations to attain sufficient funds (2) In case the crematorium is continually operated, original company should possess the priority to operate it by way of non-gratuitous type of BTO. (3) While the crematorium is terminated, it should be transformed into “ROT” with appropriate restoration. (4) For those well-operated BOO crematoriums, no specific changes are needed; however, a proper back-up plan for future state-own and private-operate should be prepared in advance, so as to establish a unified national policy toward the management of crematorium. At last, wastes in Yunlin County should be transferred to other district or to ask factories to cope with so as to prevent the crisis of the conflict of waste.
