Summary:碩士 === 臺北市立教育大學 === 國民教育研究所 === 94 === Since Taiwan practices human rights of society and schools in difficulties, and Chinese culture is deemed harmful to Western human rights, this paper find out a lot of traditional elements from records of rights and freedom among Confucianism and intellectuals in the last years of Ching Dynasty and the early years of the Republic of China. The elements are beneficial to connect Western human rights. In theory, this paper shows that (1) Chinese culture based on Confucianism include rights and freedom, (2) Western human rights based on liberalism could be root and develop in Taiwan, and in practice it contributes to (1) clarify the misunderstanding of “Chinese culture is opposed to Western human rights”, (2) better the difficulties that misunderstanding affected human rights education in schools. Second, this research tried to set up a foundational inquiry on human rights in schools that roots in Taiwan. We hope that the inquiry could clarify the common misunderstanding, better the difficulties of human rights practice, and make Taiwan a cultural change in society and schools. Finally, in study we propose that “proceeding of Taiwanese human rights theory” and “practicing of human rights in schools” could do follow-up research, and in practice we propose that a complete set of teachers’ training on human rights education should be built up while human rights in difficulties.
