| Summary: | 碩士 === 國立臺北大學 === 法學系 === 94 === As we know, automobile had been the most important invention in modern society. It bring us not only a convenience life ,but also large damages that causing economic crisis and great fear in our mind. Therefore Legislative Yuan has passed the “ Compulsory Automobile Liability Insurance Law” in 1996 in order to carry out the mission of injured party protection. In another word, the purpose of the legislation has focus on the protection of the vitim caused by traffic accident. And the law attention on the protection of traffic accident injured party has been regard as a benevolent policy ,and has widespread accepted by the people in Taiwan.
Although the injured party’s protection has made the lesgislation in the right direction, nervertheless the law status of the insured who led the traffic accident in this libility insurance law was daubtful. In another word, in order to protect the accident injured party, the law had set up some system to protect the injured, but the law had not consider that the nature of this law is “Liability Insurance Law”, that means the protection of the insured in this law is important too. So this study is try to focus on the protection of the insured in liability insurance law, and give some suggestions to the law.
