A nation consists of four main basic elements, which are the citizen, the territory, the government, and the sovereignty. The citizen is not only the basic unit to form a nation, but also the foundation of a nation. One’s nationality is the connecting factor to know what nation he belongs to; therefore, people can be distinguished from citizen to alien by nationality. It is very important for a nation or a person to acquire his nationality and lost it. However, neither all over the world nor in our nation, nationality law isn’t a popular study. Though the information isn’t enough, I’ll try my level best to analyze the articles of our country’s nationality law by the paper.
The first chapter is the introduction. The second chapter is the summary of the nationality, introducing the concept, function, basic legislation principle, convention and protocol.
The third chapter is about the acquisition of the nationality. There are two parts in it. One part is the acquisition by birth, and the other is acquisition by naturalization. I’ll first introduce the basic principles and foreign legislation, and then analyze the articles of our country’s nationality law.
The forth chapter is about the loss of the nationality. There are three parts in it. One part is the renunciation of nationality, another is loss of nationality by voluntarily obtaining naturalization in a foreign nation, and the other is deprivation of nationality. I’ll first introduce the basic principles and foreign legislation, and then analyze the articles of our country’s nationality law.
The fifth chapter will focus on the principle of the prohibition of dual nationality. Although it is a great ideal, each nation handles the issue differently. In this chapter, I will first introduce the reasons of the dual nationality and how each nation puts this principle into practice. Then I will reconsider this principle. At last, I will analyze the articles of our country’s law.
The sixth chapter, the last one, is the conclusion of the previous chapters. It will also bring some suggestions on amending nationality law.
