碩士 === 國立清華大學 === 科技法律研究所 === 94 === In order to secure the competitiveness of Taiwan's industries in international markets, National Development Plan formulated by the Council for Economic Planning and Development, coordinate with the private sector to promote emerging key industries. “Color-image display” is one of the industries that government served as the locomotive for the development of associated industries, and the overall output value is estimated to reach NTD 1.37million in year 2006 (whereas the semiconductor industries is NTD1.59 million comparatively). If the figure prevailed, Taiwan will take the pole position in the total production value of the displayers around the world. Certainly, by promoting “Color image display” industries, Taiwan should once again reach the summit of the economic growth followed by the success of IC industries in 90s. The total productivity in 2006 is expected to overtake Korea and become the most important supplier of Thin Film Transistors. Although the growing pace of flat panel industries is moving so fast that left a little time for the suppliers in Taiwan to pile down the solid foundation in the areas of product design and development. In extend, the self-dependant on the supply chained and R&D works on the sub-components are generally lacking of depth. The cases involved with the related lawsuit and the infringement solarium is increasing. By summing up all the factors, flat panel industries confront the plight such as: Intensive Patens cause obstacle on the player who comes into the filed later; key technique and Patent lag behind United States, Japan and Korea; the administration system for Intelligent Property is yet not established; increasing number of Patent Infringement Lawsuit. Local corporations accused by foreign corporation have taken place quite often lately. The strategy regarding Patent for prevention suggested herein such as: strike on international Paten Strategies; developing Patent map; getting familiar with Patent regulations world wide; utilizing patent design around and etc. The Patent strategies for accusation and Patent authorization strategies for losing lawsuit are suggested as well. By integrating the efforts from the public, private, academic, and research sectors, we believe that Taiwan will soon shake off the shadow cast by the patent infringement lawsuit and ultimately lead its way to success.
