博士 === 輔仁大學 === 法律學研究所 === 94 === 1.0 Introduction Organised crim is a very big problem in many countries,including Taiwan.My research is about this topic,but not all this area,just about the legal norm.So about the concept of organised crime is depended on law,but our law is definite? In my opinion,defining the organised crime must divide two areas:the criminal organization and use the organization to commit,and the criminal organization will be define in a narrow sense,like the Mafia or Triad.These are my research keypoints. 2.0 Anti-Organised crime law In this chapter,I will dicuss the Anti-Organised crime law in our country.In our law,including the criminal law and special law,above all the organized crime prevent act.So in this chapter,I must centralize on this act.Aside from,how to exterminate the interests of the criminal organization is the important study too. 3.0 The procedural law of investigating organized crime The police must use the special means to combate the organized crime,these measures are always between the crime-control and due-process.These measures comprise:intrusive surveillance,interception of communication, use informer and undercover.This chapter is disscused about the control of police power,not to criminals. 4.0 The criminal treatment of organized criminals Organised criminals are always served a long term time in the prison,specially the three-strikes law will lead into our criminal law.But this tough punishment really can reduce the recommitments?In this chapter,I will allege the objective views and bring the alternatives to lead a new way. 5.0 Conclusion Combating the organized crime is not a unitary but a integral work.In our country,the criminal justice of combating organized crime to use the tough punishment from now on,but this thinking is proper? This question is my motive of research and criticizing point in all my dissertation.
