碩士 === 國立陽明大學 === 醫務管理研究所 === 93 === In response to fast changes un the medical environment in recent years and to enhance their opunnional efficiency and improve service quality ,Private medical institutions have gradually shitted from sole proprietor operation and management by the practitioner to organizational management with a certain level of enconomic scale and foundation for sustainable operation . On April 28 , 2004 ,the Medical Law announced the addition of a “medical juristical person “ in Chapter 3 , With specific stipulations on the establishment ,registration , management and supervision mechanism , and non-conformance disposal . However ,it has been over one year since the announcement yet no private medical institution has filed any application . The reasons include the authority and private medical institutions have not reached consensus and many tax issues remain unsolved in the process of rights and obligations transfer . This study employed means of literature review and expert of transforming into a “Medical Juristical person “. Accordind to the Medical Law ,a hospital of a certain scale (200 beds )must transform into a “Medical Juristical person “within a specific time (3 years) after the announcement .Based on the statistical data of the department of Health in 2003 ,there are 45 private hospital with 200 beds or more in Taiwan . However , only for studies are doing research concerning “Medical Juristical person”, thus it has become an urgent issue . In this vein , this study invited companies government bureaus , academic institutions , and tax experts for in –depth interviews ,and along with thorough review of related literature and law , suggestions wetre proposed in hope to provide references to government bureaus and private medical onstitutions on transformation of private medical institutions to “Medical Juristical person “。
