It is usually treated as a panacea for the government under the financial constraint. However, privatization should not be treated solely as the shift of responsibility of public sector. Rather, it is also a challenge of transform for the role and function of the government. This critical transformation requires the changes of financial and regulatory operations involving the organization and function of public sector that further relates to the integration between public and private sectors. The pass of the Act for Promotion of Private Participation in Infrastructure Projects(Act of PPP) in Taiwan legalized the public-private partnership approach and further allowed active role of private sector/developer to in participating in the development of public-owned properties. However, under the aggressive regulatory structure, the relationship between the public and private sector will be like the proxy, and could use agency theory to analyze. When the public sector facing the financial constraints, tends to use the public rights as the instrument for complimenting public financial gap, agency problems will because the goal conflict, asymmetric information and selfish of private to show up.
