| Summary: | 碩士 === 銘傳大學 === 公共事務學系碩士在職專班 === 93 === Under the influence of globalization, not only merchandise and capitals but also people tend to flow to the best place, and it follows that frequent flows of population eventually cause social problems. However, population flows can bring economical and cultural benefits at the same time. The world keeps developing and changing with frequent and close interaction among different nations. As a result, nationality problems and arguments occur. Now it’s the most urgent thing to find a way to solve the problems with concerns of international legal order without ruining peace and security.
Nationality is the key of connections among citizens in a nation, and also the basis of right-and-obligation relationships between citizens and the nation. Presently in Taiwan there is only Nationality Law concerning nationality issue, along with enforcement details and actual execution. However, there are more and more problems concerning immigrants, population policies, acquisition of foreigner, nationality renunciation, nationality recover and canceled renunciation, expatriate identity confirmation, and public service limitations on people with dual nationality. They all need regulations. In order to deal with the more and more complicated economical and political situation in Taiwan, to help immigrants and their children blend in with local cultural knowledge, and to make people realize what our society and the next generation need, do we need to add the requirements of basic language ability and common sense of citizen’s rights and obligations for those who intend to gain nationality of Taiwan? Also, do we need to emphasize the understanding of diverse cultural perspectives and of issue concerning immigrants? In addition to legal refinements which comply with actual situations, we should do more research with scientific methods on international legal theory and on execution differentiation in cases of nationality change in basic household managing organizations. The purpose of research is to clarify key issues concerning international laws with combination of theory and practice, and to benefit our nation with better policies.
