Porno problem that can not be eliminated has long been existing in human society and the issue grows all the more complicated and obscure along with the current change of moral concepts of sex and the rise of feminism. The role to ban vice activities played by police in Taiwan frequently creates many disciplinary problems due to obscurity in policy and institution. This study is intended to analyze the crux of the problem of existing porno management measures with a pragmatic attitude acknowledging the basic human needs of sex, and probe the feasibility to put prostitution under special sector management, its gain and loss, and, at the same time, making policy suggestions that fit the actual living environment in our country.
This paper adopts the theoretic concept of ‘market malfunction’ as well as ‘government malfunction’ by choosing Taichung City its range of study, making further key personnel, people’s representatives elected, persons in line of porno business, and the prostitutes, its objects for first-hand in-depth interviews. A total of 19 persons were interviewed in April and May 2005, in reference to the historical changes and development of porno culture in Taichung City while comparing also with the related porno management systems enforced in Europe, USA, Japan and others.
It is found that the present porno business management policy has driven the porno activities underground and surfaced the social problems in health, safety, security, and police conduct, in addition to some severe damages to the labor rights and employment protection of people in porno business.
With regard to the establishment of special sector(s) for porno business management, the interviewees had shared the high degree of cognition by affirming the open prostitution that renders the effect valuable and taking into account the foreign porno business management policy that can certainly be transplanted to and put into practice in our locality. Particularly, the settlement of vice sector(s) shall have a positive meaning to public security and police discipline.
This paper makes some policy suggestions: Recognizing the porno business (activity) a legitimate act; taking positive action to amend laws and acts to protect legalized prostitution; guiding the porno business personnel in the formation ofunions and setting aside ‘erotica sector(s)’ to detect public opinions and expedient measures of policy execution before establishing vice sector(s) actually. It hopes to overcome the current contradictions within porno management system brokenloose from society and to make the management policy correspondent with socialreality.
