碩士 === 長榮大學 === 經營管理研究所 === 93 === Abstract In Taiwan, no matter what kind of industry it is, the law of the intellectual property such as domestic Trademark Law, Patent Law, Copyright Law and Fair Trade Law etc must protect its products and developed commodities. Originally, enterprises just have to raise funds, recruit the talented people, organize the factor exoenzyme, develop techniques, and consider human resource management etc if they want to earn money. However, along with the facilitation of internet, the advancement of technology and the vigorous competition among industries, enterprises start to notice the importance of the trade secret keeping handing of the industry, that is the commodity has not yet practiced and the company makes the precaution against spies before selling the commodity. The trade secret keeping handing lets the enterprises hold nothing but competitive superiorities. This study takes the Exploratory Research as to study channel, and it gathers and analyses the cultural heritage and data about the industry secret keeping system and the intellectual property. It also adopts analytical articles of traditional cultural heritage to inquire into the articles of law of the right of property keeping system and the intellectual property articles. Besides, this study adduces foreign related law, international covenant and related cases to compare and analyses the relationship between the trade secret and intellectual property. Moreover, this study investigates four cases and analyses the discussion with scholars and related operators about the related trade secret keeping handing. However, most of the current correlation researches of the intellectual property keeping emphasize too much in the study torah bedding plane or put great emphasis on how to procure intellectual property. They mention very few in the trade secret keeping handing. Therefore, the trade secret keeping handing becomes the most important part of this study. This study emphasizes on how to program with the establishment enterprise trade secret system of administration, which includes advance of the precaution and the ex post handles style and also hopes to become the reference for the domestic firms. This study wants to reach the following targets: A. Understanding the correlation between the intellectual property keeping and trade secret management system. B. Understanding how to carry out the content of the intellectual property protection and the trade secret management system. C. Suggesting and providing the system of administration of the trade secret and examine tables for the domestic industry to carry out trade secret management system.
