And asylum also became a serious problem to be resolved, member states worried about phenomena of “ asylum shopping ” would expand, thus in 1990 Dublin convention was signed to create one people one asylum application system in EU. Before 1997 asylum policy was processed in intergovernmental cooperation model, therefore achievements were very limited. Until Amsterdam Treaty, asylum policy was moved to the first pillar, common asylum policy started its path. The thesis is focus on two parts: the first is on asylum community law, especially secondary law with legal binding, in the period of Amsterdam Treaty; the second part will emphasize on social condition of refugees and asylum applicants in member states, including short term occupations, like education, employment and medical care, and long term are family reunification and refugees’ citizenship. We should also pay attention to the future of EU asylum policy developments, because new ten member states will attend EU officially in May 2004, more border security problems are foreseen. Not only Western European countries have to worry about refugees flow from east side, but Eastern Europe encounter more difficulties: their transformation is from seeking asylum countries to receiving ones, in addition they are also forced to accept many Acquis Communautaire. In recent 20 years, EU asylum policy developments slowly violate international human rights codes, and EU is gradually building a “European Fortress” to prevent more refugees to enter EU. Finally state sovereign will limit the future of EU common asylum policy, member states still insist on deciding individually which applications can be granted asylum, and they possibly cooperate only on administrative matters, or just figure out how to stop refugee flows.
