Colombia is a long-standing democratic country in Latin America. For a long time, the two principle parties — the Conservatives Party and the Liberal Party dominate the state and takes turns as the ruling party. Generally speaking, democracy strengthens human rights and democratic countries typically pay more attentions to human rights. According to the Human Development Reports of the United Nations Development Programme(UNDP), there are forty (40) Human Development Indices (HDI) about human rights and freedom , of which Colombia has only fulfilled fourteen (14) items. Furthermore, according to the evaluations of the Freedom House in the U.S. Colombia did not become a democratic country from restricted democratic practices country until 2000.
From our investigations of the human rights situation in Colombia, we discover that politically Colombia appear to have a democratic regime around the major
metropolis in the country. But in reality, the guerrilla troops, paramilitary forces and drug mafia engaged in serious conflicts, and resulted in a vicious circle of kidnapping 、abduction 、murder 、assassinations on a daily basis. And, the weakness of the judiciary system and the allegiance between the military and the paramilitary forces have made the matter even worse.
The mentioned facts deteriorate the problem of human rights in Colombia. According to the report between April and September of 2000, there were nineteen (19) people killed daily by armed conflicts. Among them, 79.5% was due to the government and paramilitary forces, and the armed forces were responsible for the other 20.5%. Although the people in Colombia have the full rights to vote in their daily life, they are threatened by multiple armed forces in the country. What happened in Columbia makes the human rights situation worse and motives the topic of my thesis. In other words, the purpose of my thesis is to examine the compatibility between the law and the human rights protection by researching the human rights situation in Colombia from its constitution laws、documents、and from International nternational Human Rights Conventions and International Non-Government Organization (NGO)''s reports.
