Ensuring the security of the nation, combining with the national construction, and supporting the all kinds of military missions, the military construction and maintenance are not only the foundation of overall hardware up of national defense, but also an important part of governmental public construction. Therefore, the efficiency of executing and managing all military construction and maintenance projects is concerned with the result of war preparing, training, rear-service missions, the fighting capability, living quality, and even the image of our country. Over years of executing and practicing Army Refining Project, National Defense Law and National Defense Constituent Act, the annual budget of military construction and maintenance still reaches the figure of tens of billions for all the consolidation of departments and reduction of employees. Nowadays, because of the development of democratic society, the vast array of disputes and litigations about military construction and maintenance usually results in the exhaustion of project managers’ energy and time, just like the situation of public construction and maintenance that come up against more and more disputes and litigations with time. Even though the Committee of Public Construction in Executive Branch helps a lot with negotiations, complaints, arbitration, and litigations, the problem not only delays the time limit and budgeted expenditure of projects, but also severely influence the management of the cost and efficiency of military construction and maintenance. Therefore, my research is focusing on law reviews about military construction and maintenance, Public Construction Law, case studies, and the investigation of the professionals’ capacity. Furthermore, after analyzing and surveying the differential factors, such as the professional staff, regional features, rate of closing tenders, and deficiencies of cases, the next step is to conclude with a suggestion that conforms to management science. Finally, this paper is supposed to serve as a reference for managing the cost , increasing the efficiency, and improving the quality of our military construction and maintenance.
