Police neutrality is built on the “equality principle” as stated in Article 7 of the Constitution of the Republic of China. The principle provides that the police shall maintain their neutrality and independence when carrying out their duties and treat all political parties, groups or individuals irrespective of their sex, religion, race, social class, or party affiliation equally before the law. The police shall dutifully carry out their duties and shall not interfere with any party disputes. The objective of this study is to undertake empirical research on the aforementioned viewpoints with the expectation of proposing some effective strategies for solving the predicaments of police neutrality, which in turn will help establishing the police’s image as fair, unprejudiced and professional law executors.
The study undertakes both qualitative and quantitative analyses, which include literature reviews, surveys and in-depth interviews. First, the concept of police neutrality is defined and then three major perspectives that are likely to impact police neutrality namely, “political”, “regulatory” and “administrative” are determined based on literature reviews and theory. Further, as an extension from the three major perspectives, eleven variables namely, “the lifting of the Martial Law”, “rotation of political parties”, “political interference”, “political figures, (citizens’ representatives)”, “the effects of regulatory requirements”, “standard operation procedures”, “ethical reasons”, “value concept”, “educational training”, “training process” and “police” are analyzed and explored.
The author takes the aforementioned perspectives as the basis and designs the questionnaire and questions for the in-depth interviews. Both closed-ended and open-ended questions are utilized in the questionnaire aiming at obtaining data with higher accuracy and validity. The study further undertakes descriptive statistical analysis, the t-test, one-way ANOVA and relational analysis to gain an understanding on the respondents’ attitude and views on administrative neutrality. The study also examines the population variable and the relationships between the variables as well as undertakes tests on the hypotheses to validate whether significant relationships exist between the variables. In-depth interviews are conducted on twelve researchers, competent and specialized in administrative neutrality. The results of the in-depth interviews are compiled and presented in the “interview transcript”, allowing the causes of the issues to be genuinely reflected. At last, the results of in-depth interviews, which more closely reflect the reality, are compared with the survey results and recommendations are proposed in the last part of the study for the relevant organizations to understand and improve the issues.
