Summary:博士 === 國立臺北大學 === 公共行政暨政策學系 === 92 === This study aims at the formulation of collective bargaining system of Teachers’ Associations in Taiwan and the specific solution of system structuring. The research methods applied in this study included document analysis, questionnaire survey and historical-comparative analysis. In document analysis,the focus of scope were collective bargaining system and contracts of employment in Taiwan, England and U.S.A. In questionnaire survey, the samples for the study were the members of convention of National Teachers’ Association (NTA)-the decision group of NTA. There are some key findings and conclusions of this study below: A. The construction of collective bargaining system in Taiwan has legitimacy on both theory and constitution. B. The public conflict caused of collective bargaining has positive functions . C. In England and U.S.A., the structural relations of teacher union collective bargaining system were combination of legalism and voluntarism. D. In Taiwan, the structural relations of collective bargaining between Teachers’ Associations and educational authorities (employers) were unsymmetrical, inclined to educational authorities. E. Most members of NTA decision group support both the enlargement of scope for bargaining and the construction of collective bargaining system. F. The principles of formulation for collective bargaining system are below: 1 The stage of preparation (1) Build statutory certification procedure and exclusive recognition model. (2) Enact regulation for the obligation to bargain and unfair labor practice. 2 The stage of proceeding (1) Add more economic issues (ex. extra compensation), institutional issues(ex. union security) and administrative issues (ex. standards of teaching profession) to the scope of contract bargaining. (2) Build the regulation for strike and other alternative impasse resolution procedures. 3 The stage of implementation: introduce the grievance arbitration to collective bargaining system. In summary, the study offers some key suggestions to the relevant parties: A. For government 1 Advocate the positive view for managing public conflicts. 2 Public administrators should be training for the ability of using alternative dispute resolution(ADR). 3 Enact Teachers’ Association Law. B. For Teachers’ Associations The development of organization should be considerable on both unionism and professionism.
