Description
Summary:碩士 === 國立臺北大學 === 法學系 === 92 === Followed by the development of electronic commerce, the Internet transaction has been widely popularized. Therefore, disputes coming from Internet transaction between the consumer and the producer also have been increased. Since the amount of money behind this kind of Internet transaction dispute usually is not huge, it is not economical to solve the dispute like the litigation does. Hence, there is the introduction of Alternative Dispute Resolution (ADR). With ADR, it is easier for consumer to build online shopping confidence, and then for the electronic commerce to be further developed. This thesis starts with an overview of Internet transaction. Then we provide a discussion of ADR, which includes the introductions of both international and domestic ADRs. Finally, an analysis of Online ADR (Online Alternative Dispute Resolution), which is at the basis of the Online Arbitration, will be presented. To do so, we first discuss the natures of Online ADR. Next, we elaborate upon various arguments that Online Arbitration is encountering. At last, we conclude with concrete suggestions for the future development of Online ADR here in Taiwan.
