Summary:碩士 === 國立東華大學 === 公共行政研究所 === 92 === The domestic land resource is insufficient, and the life space is crowded, so the land becomes a kind of rare goods, however because the land has the characteristics such as "the position is impossible to move", "the quantity is unable to increase naturally" and so on, so everyone regards the public land as the mineral resource which may dig out arbitrarily, as long as the opportunity one has, never easily to give up. Some people want to occupy the public land by all means. Up to December 2003, according to the State Property Bureau statistical data, the public land in Taiwan is occupied illegally as high as 60,000 hectares, and more than 370,000 items. To study the reason why they could occupy the public land, we found that they received the public land from the Japanese public and private industrial when the Japanese went back to Japan after World War II that Japan was defeated by China about 55 years ago. For alternating of the government, and the manpower of the public property administration is insufficient; or people do not know the law clearly, even they do not obey the law. So the public property administration cannot manage the public land effectively. While the population increases fast, as well as the society, economics and the politics structures change rapidly, the demand of lands rises higher and higher. But the public property administration does not have the public authority to tear down the unlicensed buildings, and the local government, which has the public authority to tear down the unlicensed buildings, cannot cooperate with the public property administration effectively. So that the public land has been occupied for quite a long time. Though the State Property Bureau has taken many measures to check and to cope with the occupied public land for many years, and they have some results. But until now the occupancy problems still exist; it seems unable to extinguish the occupancy problems completely. The state properties are truly enormous and complex; it is difficulty to manage the public land effectively by the present control system. This research tries to explore the occupancy problems deeply, and suggest the State Property Bureau to implement the rental system, and establish diversified approaches, such as out sourcing, collaborations, partnerships and so on. So that the people can rent the public land to achieve the effective nimble utilization, and let all the people share the benefit. It is the responsibility for the public property administration to solve the occupancy problems. Here are six chapters in this article, to explore the public land occupancy problems, and analyze the reasons of occupancy, then hope that can help the public property administration to manage the public land more effectively.
