This paper adopts qualitative and quantitative method, documentary analysis and Delphi Method as primary research methodologies. A “Questionnaire for Policy Formulation of School’s Physical Education Policies” was also compiled to serve as tool for survey. Survey was conducted by filling out of questionnaire with 10 experts, scholars and administrative personnel twice. Average scores and mode as were used to calculate the statistics. Analysis and discussions led to the following concrete conclusions: 1. In order of level of importance, factors influencing the formation of problems in school’s physical education policies in Taiwan can be divided into physical education activities, physical education teachers, physical education instructions, educational concepts, sports facilities, education and culture, society, economic and political aspects. 2. Substance of school’s physical education policies in Taiwan includes eleven concepts of converting basic human rights (rights of survival, right to work and property rights) that include rights to sport. 3. It is believed that there is a necessity to formulate a “School Physical Education Law”, form and structure of legalization of school physical education policies laws should be coordinated with amendments in current existing laws. 4. Overview of current implementation of school physical education policies includes 7 elements relating to clearness and comprehensiveness of implementation of school’s physical education policies 5.
