Summary:碩士 === 國立清華大學 === 高階經營管理碩士班 === 91 === In the twentieth century that the network technology and E-Business are global, the international trade among countries becomes frequent. However, due to the differences in languages, laws and customs, many complaints and claims are caused by the problems of communication and misunderstanding during the international trade transactions. Besides spending lots of time and money on settling the claims, the loss even made many companies and manufacturers bankrupt. Although there is no exact prevention to avoid the magnificent claim happenings, the international traders could pay more attention to prevent the happenings if they know the whole flow chart of international trade and pay more attention to the steps where the claims might happen before signing the contracts. It would be helpful to prevent the happenings of the claims. In the chapter three of this study, I listed the whole flow chart of international trade, and in the chapter four, I summed up the steps where the claims possibly happen for reference. If any claim happens, how to handle it and settle it peacefully according to the international customs are summed up in the chapter two. In the Chapter five, I took some true examples and cases that happened in USA, Europe, Asia and China from my past 20 years' working experience in the field of International Trade. I analyzed the reason of the claim happening, and gave the suggestions of settlement and prevention for each case by using the above theory. And the conclusion is that all claims and disputes are actually preventable. I hope this study could be a good reference of troubleshooter for the people who are working in the field of international trade.
